Warrington Borough Council had refused outline planning permission for a replacement dwelling in the Green Belt of similar size, height, siting and general appearance to one that had previously existed, and which had been substantially, but not wholly demolished. Philip had been the agent for the application.
Citing relevant case law at a hearing into the subsequent planning appeal, Philip persuaded the appointed inspector that the residential use of the site had not been abandoned. Moreover, having regard to national and local planning policies on replacement dwellings in the Green Belt, the inspector agreed that the proposed replacement dwelling would not harm the character and appearance of the countryside or the Green Belt. He therefore allowed the appeal.
The case demonstrates the importance of having a sound understanding of planning law when setting out the arguments in favour of a proposed development.
